Amendments to the Legislation in the Field of Humanitarian Aid

To the attention of volunteers, charitable and public organizations that provide humanitarian aid to the Ukrainian military, volunteers and territorial defense.

Starting from March 26, 2022, it has become much easier for volunteers, activists and public organizations who tend to the logistics of our defenders, to bring bulletproof vests, helmets and other military equipment to Ukraine.

In particular, through the Resolution of the Cabinet of Ministers of Ukraine of March 26, 2022 No. 362, the Government amended the Resolution of the Cabinet of Ministers of Ukraine of March 1, 2022 No. 174 “On Some Issues of Delivery of Humanitarian Aid across the Customs Border of Ukraine during Martial Law” and equated helmets and bulletproof vests to humanitarian aid, which simplified the procedure for their transportation to the customs territory of Ukraine.

Thus, for the period of martial law, special personal protective equipment (helmets, balaclavas, shock absorbers), bulletproof vests, fabrics (materials) for the manufacture of bulletproof vests) can be crossed through the customs border of Ukraine by submitting a declaration filled in by the person transporting the goods. These goods are recognized as humanitarian aid on a declarative basis without a decision of the specially authorized state bodies on humanitarian aid.

Important changes have also taken place in relation to other equipment needed by our military.

Starting from March 26, 2022, for plates for bulletproof vests, portable radios for non-civilian purposes, unmanned aerial vehicles (quadcopters) for non-civilian use, binoculars, monoculars and other optical tubes, magnifiers for non-civilian purposes, collimator sights, optical sights for non-civilian purposes, thermal imagers, night vision devices, only the end-user guarantee letter is required (Annex № 3 of Resolution No. 174).

This letter shall be drawn up by the end user of humanitarian goods, which is a military administration body designated by the Ministry of Defense, a law enforcement body, another military formation established in accordance with the law, or another entity engaged in combating terrorism in accordance with the law.

It should be noted that the recipient of such humanitarian aid (end user) shall notify the State Service for Export Control of Ukraine of its receipt (indicating the name and quantity of goods actually received) no later than three days from the date of receipt of the goods by sending a certified copy of the guarantee letter. Information may be provided electronically through electronic digital signature certification.

Thus, simplifying bureaucratic obstacles and defining helmets and bulletproof vests as humanitarian aid will provide even more motivation to volunteers and our foreign partners to help Ukrainian warriors.
